Public Interest Foundation & Non-profits - Application - Two Points Not Specifically Mentioned In Law - #17

When it comes to the submission of your foundation or non-profit as a licensed Luxembourg public interest organisation (reconnaissance d’utilité publique), it is important to bear in mind two points during the application process.

We had previously published an article on the conditions to be licensed as a public interest organisation in Luxembourg (see this article, in French in our Vademecum at: https://mariauxavocats.com/vademecum ). These conditions remain today. The law has not changed yet. However, in a more practical manner, I want to draw your attention on two points which you must include in your application file.

A detailed memorandum on how the entity shall operate (in a very practical, precise and concrete manner) must be included in the submission to the Minister of Justice

To that end, a five-year financing plan shall also be enclosed in our application.

We shall then be ready to meet the Minister of Justice or one of her/his advisers. The founders of the organisation must be present at this meeting.
